and/or conservation easements acquired consistent with HMP criteria contained in the <br /> Master Plan. This HCP mitigation applies to terrestrial species only. <br /> 1. Setbacks for Sludge Basins: A minimum 20-foot setback from property lines is <br /> required for any sludge basins. (Development Title Section 9-710M [c] (4). <br /> j. Wetland Mitigation: The following wetland avoidance and mitigation shall be required <br /> consistent with the requirements of the Mitigated Negative Declaration: <br /> (1) All structures and developed surfaces (excluding the landscaped buffer) shall be <br /> located a minimum of 50 feet from the delineated edge of the wetland as <br /> determined by a qualified biologist. <br /> (2) The Dry Creek Wetland, including the 50-foot buffer area, shall be subject to the <br /> following wetland protection measures: Prior to initiating earth moving activities <br /> at the site, the wetland boundary shall first be Flagged by a wetland specialist, <br /> and then a temporary construction fence shall be installed landward of the <br /> wetland boundary. This fence should be maintained until all construction <br /> activities are completed, and prior to removing the temporary fence, a wetland <br /> specialist shall again inspect the site to confirm that no incidental impacts have <br /> been incurred. <br /> (3) A silt screen, anchored by hay bales, shall then be installed on the water <br /> treatment plant side of the temporary construction fence. This silt screen shall <br /> remain in place for one complete rainy season following completion of <br /> construction. <br /> (4) The raw water pipeline shall be constructed consistent with the terms and <br /> conditions of the Corps of Engineers' Nationwide Permit for utility line crossings. <br /> This applies to the section of the pipeline within San Joaquin County as well as <br /> the larger portion located outside of the County. A copy of the Nationwide <br /> Permit shall be submitted to the Community Development Department and to <br /> the U. S. Fish and Wildlife Service. <br /> k. Cultural Resources: If, during the course of construction, subsurface historic <br /> archaeological features are identified, work should be immediately halted in the vicinity <br /> of the finding and a qualified archaeologist consulted for an on-site evaluation. Further, <br /> if artifacts or evidence of materials such as bone, shell or non-native stone are <br /> uncovered during construction activities, work should immediately be halted in the <br /> vicinity of the finding and a qualified archaeologist consulted for an on-site evaluation <br /> (Master Plan Section 7.4, Implementation Measures [b] and [c]). <br /> I. Timing: The water treatment and reclamation facilities required for development of the <br /> first phase of development shall be complete and operational prior to the issuance of a <br /> permit to coristruct a building (other than those required to construct the water and <br /> wastewater treatment plants). This is a tentative condition based on action scheduled <br /> before the Board of Supervisors on May 12, 1998. If this proposed change is not <br /> approved, than this condition shall be fulfilled "prior to approval of the first Final Map." <br /> (Master Plan Implementation Measure 12.3.6 [a]) <br /> M.
