A bond or cash deposit in the amount acceptable to the Department of Public Works <br /> shall be filed with the Department with a guarantee that, if the Permittee fails, refuses, or <br /> neglects to repair, under permit, any damages to Koster Road, Blewett Road or Bird <br /> Road, which may result from Permittee's operations, the Department of Public Works <br /> may do the work necessary to restore those roads and bridges equal to, or better than, <br /> its original condition, using the funds from said bond or cash deposit, subject to review <br /> and adjustment for inflation every five years. (Development Title Section 9-854.3) <br /> e. The Traffic Impact Mitigation fee will be required for this development. The fee is due <br /> and payable at the time of building permit application. The fee currently is $168.90 per <br /> daily trip-end in the Tracy area. The fee shall be automatically adjusted .July 1 of each <br /> year by the Engineering Construction Cost Index as published by the Engineering News <br /> Record. <br /> f. The Koster Road bridge across the Delta-Mendota Canal has insufficient strength and <br /> width for current highway standards. If the bridge is used for the haul route, it shall be <br /> fapiased modified with a b0dq to provide a clear width of 28 feet and meeting current <br /> design standards. <br /> 1. If the entrance to the project is located on Koster Road, Koster Road, from the <br /> entrance to Blewett Road, shall be dedi ated aG1 reconstructed to orovide a road <br /> with a 24-foot pavement width with improved shoulders within the existing right-of- <br /> way and using a traffic <br /> index for a 20-year design. A traffic study shall be prepared to determine the structural section requirements of <br /> Koster Road, Bfewett Rod and Bird Road or any impacts and mitigation measures. The <br /> developer shall deposit funds with the County for all costs, as estimated by the Public <br /> T Facilities Division of the Department of Public Works, prior to Public Works preparing or <br /> contracting for the required study. Any mitigations required by the traffic study shall be <br /> provided by the applicant. (Development Title Section 9-1150.4) <br /> h. Access easements shall be required from adjacent property owners for any access roads <br /> through their properties. <br /> -20- <br />
