( n rv�s/ <br /> Oak Trees L <br /> The site contains a number of valley oak trees as identified in the preliminary biological resources <br /> assessment for this site. To protect and preserve heritage oak trees and native oak trees from <br /> development and construction activity the Community Development Department recommends the <br /> following condition: <br /> i) TREE PRESERVATION: The subdivision improvement plan shall indicate whether or not any trees will <br /> be removed. If trees are to be removed, the method of replacement shall be described, consistent with <br /> Section 9-1504.4 of the Development Title. If trees are to remain, development constraints shall be <br /> noted on the subdivision plans, consistent with Section 1505.5 of the Development Title. <br /> Noise <br /> Development Title Section 9-1025.9 lists the Residential use type as a noise sensitive land use. <br /> Development Title Section 9-1025.9(d) states that the Review Authority shall require the preparation of an <br /> acoustical study in instances where it has been determined that a project may expose existing or <br /> proposed noise sensitive land uses to noise levels exceeding the noise standards specified in Table 9- <br /> 1025.9. An Environmental Noise Analysis was prepared by Bollard & Brennan, Inc. on April 24, 2004 and <br /> the analysis determined that the proposed residences nearest to Lower Sacramento Road would be <br /> exposed to future traffic noise levels which exceed the 65 dB Ldn standard for San Joaquin County. The <br /> analysis recommends the following conditions shall apply: <br /> i) A six foot noise attenuation wall made of concrete or masonry block is required along the western property <br /> line of Lots 1 and 37 respecting the right of way of Lower Sacramento Road and the wall shall be included <br /> in the improvement plans. <br /> Project Proponents and Opponents <br /> The Community Development Department has received (2) letters in support of the project and a signed <br /> petition with 48 signatures opposing the project.. Opponents to the project raised issues and concerns <br /> regarding the small size of the parcels (one acre), the depletion in the water table, relocating access along <br /> Lower Sacramento Road to Liberty Road and Liberty Road being widened, and the overcrowding of <br /> schools. The concerns are discussed below. <br /> Size of Parcels: The tentative map is consistent with the requirements of Development Title Section 9- <br /> 310.3 for Rural Residential zones. The minimum lot size for this zone is 1 acre or 43, 560 square feet. All <br /> lots proposed for this project are no less than 1.0 acre in size and the average lot for the proposed project <br /> is 1.38. All other development requirements contained in the Development Title and County standards are <br /> IL rr therwise satisfied. <br /> c //� <br /> Or✓ Depletion of Water Table: As required by Development Title Section 9-1120.2 the project shall be served <br /> by a public water system conforming to the requirements of the San Joaquin County Environmental Health <br /> l� fc Department and Department of Public Works. Additionally a Master Plan for water system shall be prepared <br /> 1J,.-,qr,,pSior to approval of the Final Map. Also, water meters shall be installed on all water services. Residential Lots 23 <br /> through 37 shall have restricted access to Lower Sacramento Road and Liberty Road.
