Declarant is the Owner of certain real property in the unincorporated are of <br /> Stockton, County of San Joaquin, State of California, more particularly described in <br /> Exhibit A attached hereto and incorporated herein by this reference ("Covered Property"); <br /> B. Declarant intends to construct either duplex or triplex residential dwelling <br /> units on the Covered Property on a total of eleven (11) lots; and be in a <br /> position to convey said lots to members of the public; <br /> C. Declarant desires to set forth certain obligations of the Owners (as defined <br /> herein) concerning the portion of the Covered Property owned by Declarant or <br /> conveyed to the Owners. <br /> D. Declarant hereby covenants, agrees and declares that all of its interest, as the <br /> same may from time to time appear in the Covered Property shall be held, sold, <br /> conveyed, encumbered, hypothecated, leased, used, occupied and improved subject to the <br /> easements, restrictions, reservations, rights, covenants, conditions and equitable <br /> servitudes contained in this Declaration, all of which are for the purpose of uniformly <br /> enhancing and protecting the value, attractiveness and desirability of the Covered <br /> Property, in furtherance of a general plan for the protection, maintenance, subdivision, <br /> improvement and sale of the Covered Property or any portion thereof and which are <br /> hereby declared to be for the benefit of such portions of the Covered Property as may be <br /> owned from time to time by Declarant and the Owners. The covenants, conditions, <br /> restrictions, rights, reservations, easements, and equitable servitudes set forth herein shall <br /> run with and burden the Covered Property and any portions into which it may be divided <br /> until released as provided herein, shall be binding upon all persons having or acquiring <br /> any right, title or interest in the Covered Property, or any part thereof, their heirs, <br />
