successors and assigns and shall inure to the benefit of,be binding upon and may be
<br /> enforced by Declarant and its respective heirs, executors, administrators and assigns.
<br /> ARTICLE 1.
<br /> DEFINITIONS
<br /> Definitions. Unless otherwise expressly provided, the following words and
<br /> phrases when used herein shall have the meaning hereinafter specified.
<br /> 1.1. Beneficiary. Beneficiary shall mean a mortgagee under a Mortgage or a
<br /> beneficiary under a deed of trust, as the case may be, and the assignees of such
<br /> Mortgagee of beneficiary.
<br /> 1.2. Com. City shall mean the City of Stockton, in the County of San Joaquin,
<br /> State of California, and its various departments, divisions, employees and representatives.
<br /> 1.3. Coun . County shall mean the County of San Joaquin, California, and its
<br /> various departments, divisions, employees and representatives.
<br /> 1.4. Covered Property. Covered Property shall mean and refer to all of the real
<br /> property described on Exhibit A attached hereto and incorporated herein by this
<br /> reference; provided, however, when used herein as to any single Owner, the term
<br /> "Covered Property" shall only mean that Lot which is owned by such Owner, or the
<br /> lessee of such Owner, as the case may be.
<br /> 1.5. Declarant. Declarant shall mean PLYMOTH OAKS, LLC, a California
<br /> limited liability company, its successors and any Person to which it shall have assigned
<br /> any rights hereunder by express written assignment.
<br /> 1.6. Declaration. Declaration shall mean this instrument as it may be amended
<br /> from time to time.
<br /> 1.7. Deed of Trust. Deed of Trust shall mean a mortgage as further defined
<br /> herein.
<br /> 1.8. DRE. DRE shall mean the California Department of Real Estate and any
<br /> successors thereto.
<br /> 1.9. Family. Family shall mean (a) a group of natural persons related to each
<br /> other by blood or legally related to each other by marriage or adoption or (b) a group of
<br /> natural persons not all so related, but who maintain a common household in a Residence
<br /> Unit located on a Lot.
<br /> 1.10. Improvement. Improvement shall mean any structure or appurtenance
<br /> thereto of every type and kind, including but not limited to buildings, walkways, sprinkler
<br /> pipes, recreational facilities, laundry facilities, roads, driveways, parking areas, fences,
<br /> screening walls, block walls, retaining walls, stairs, decks, landscaping, antennae, the
<br /> paint on all exterior surfaces, hedges, windbreaks, patio covers, railings, plantings,
