TA-96-5 OF SAN JOAQUIN COUNTY <br /> (ALL SUPERVISORIAL DISTRICTS) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Development Title Text Amendment Application No.TA-96-5 based on the ability <br /> to make the required'Basis for Development Title Text Amendment'contained in the staff <br /> report. <br /> BACKGROUND: <br /> Development Title Text Amendment Application No. TA-95-7 contains a number of revisions to and <br /> clarifications of the County's Development Title. Briefly, the Text Amendment application would: <br /> Section 1 adds a text provision and amends Table 9-305.2 to permit the Automotive Sales and Services- <br /> Parking use type in the Low Density Residential (R-L), Medium Density Residential (R-M), Medium-High <br /> Density Residential and High Density Residential (R-H) zones (but not the Rural Residential (R-R) or Very <br /> Low Density Residential (R-VL) zones), subject to an approved Use Permit. Typical uses include parking <br /> lots and garages. <br /> Section 2 revises the locational criteria for the Equipment Sales and Repair, Farm Machinery Sales use <br /> type by eliminating the requirement that the use be established on an existing parcel that is five acres or <br /> less, and revises the access requirement to a Collector or higher classification roadway rather than a <br /> Minor Arterial or higher classification roadway. <br /> Section 3 revises the area requirements for Second Unit Dwellings to permit units up to 1500 square feet <br /> instead of 1300 square feet. As previously worded, only one mobile home manufacturer could comply. <br /> Section 4 adds a provision related to Major and Minor Subdivision applications that extends the life of a <br /> tentative map for the period of time a lawsuit against the tentative map approval was pending before a <br /> court of competent jurisdiction. This provision is consistent with Sections 66452.6(c) and 66463.5(e) of <br /> the Subdivision Map Act for Tentative Final and Parcel Maps, respectively. <br />
