v ../ <br /> LEASE AND USE AGREEMENT GUIDE <br /> June 6, 1984 <br /> PURPOSE. The purpose of this Guide is to assist Sponsors in the preparation <br /> of eases or use agreements at airports subject to Grant Agreement obliga- <br /> tions, and/or the terms and conditions of Surplus Property Instruments of <br /> Disposal . <br /> The requirements of (1) Grant Agreement Assurances and (2) Surplus Property <br /> Instruments are similar in most respects. This Guide includes the basic <br /> provisions to be included in both aeronautical and non-aeronautical leases or <br /> use agreements at airports subject to either (1) or (2) above, or subject to <br /> both (1) and (2) above, and also dependent upon whether or not the grant of <br /> the right or privilege is to render accommodations and/or services to the <br /> public on the premises leased. <br /> Part I <br /> SCOPE. Lease, license, permit, contract, etc., for the right or privilege to <br /> provide services, accommodations and/or commodities to the public for the <br /> following classes of activities: <br /> a. Direct b Supportive Aeronautical . The following activities, commonly <br /> conducted on airports, are aeronautical activities: air carrier, <br /> charter operations, pilot training, aircraft rental and sightseeing, <br /> aerial photography, crop dusting, aerial advertising and surveying, <br /> aircraft sales and services, sale of aviation petroleum products <br /> whether or not conducted in conjunction with other included activi- <br /> ties, repair and maintenance of aircraft, sale of aircraft parts, and <br /> any other activities which because of their direct relationship to <br /> the operation of an aircraft can appropriately be regarded as an "aero- <br /> nautical activity". <br /> b. Complimentary Aeronautical . The following are examples of what are <br /> not considered direct and supportive aeronautical activities: ground <br /> transportation (taxis, car rentals, limousines) ; restaurants; barber <br /> shops; auto parking lots; recreational facilities and any other <br /> commodities, services or accommodations made available to the general <br /> public. <br /> Lease Provisions. The following numbered provisions contained in Part III of <br /> this guide sou d be included in the class of agreements referred to in direct <br /> and supportive aeronautical (Part Ia) above: <br /> A. Grant Agreements (1 thru 15) <br /> B. Surplus Property (1 thru 16) <br /> C. Both Grant Agreements E Surplus Property (1 tbru 16) <br /> The following numbered provisions contained in Part III of this Guide should <br /> be included in the class of agreements referred to in complimentary aeronauti- <br /> cal (Part Ib) above: <br /> �- <br /> A. Grant Agreements (1 thru 14) <br /> B. Surplus Property (1 thru 14 and 16) <br /> C. Both Grant Agreements d Surplus Property ( 1 thru 14 and 16) <br />
