(3) Impact Fees for Public Improvements. Impact fees for <br /> public improvements, other than Traffic Impact, will be <br /> determined at the time of permit approval in accordance <br /> with the regulations in effect at the time a specific <br /> land use or subdivision application is submitted. <br /> (4) Airport Improvements. DEVELOPER shall pay for all air- <br /> field improvements and maintenance to taxiways and <br /> aprons constructed by DEVELOPER. <br /> (5) Airport Fees, Charges or Rentals . All aeronautical sup- <br /> port businesses benefitting from a "through the fence <br /> operation" shall pay all applicable fees, charges or <br /> rental payments. <br /> (6) Costs of any land for off-site improvements acquired <br /> through eminent domain proceedings. <br /> E. Life of Subdivision Maps. Pursuant to Government Code <br /> Section 66452.6(a) , the term of any Parcel Map or any other ten- <br /> tative map filed subsequent to the Effective Date of this <br /> Agreement shall automatically be extended for the term of this <br /> Agreement. <br /> Section 3 . Obligations and Contributions by Developer. <br /> In consideration of the COUNTY entering into this Agreement, <br /> DEVELOPER agrees not to protest the assessment of Road <br /> Improvement Fees allocated to the Project for the Arch-Airport <br /> Specific Road Plan (which is presently being prepared by the City <br /> of Stockton) , and for the construction of improvements for West <br /> State 99 Frontage Road. DEVELOPER is not precluded from par- <br /> ticipating in and providing input at any public hearing held to <br /> 12 - <br />
