Community Development Department <br /> PA-0200462 <br /> The District has developed a two-phase approach to mitigating the impact of <br /> housing development and the resultant student housing needs. The District <br /> currently collects $2.05 per square foot for developers' fees, and has established <br /> an annexable Community Facilities District (Mello Roos) to collect t h e <br /> remaining calculated mitigation amount, which is currently S13,312. It is <br /> our expectation that all new development within the Linden <br /> Unified Schools attendance areas will be annexed into t h e <br /> Community Facilities District through mitigation agreements with <br /> the developers. We will be approaching the developers of this property in <br /> an effort to negotiate a fair settlement on behalf of the district. The Linden <br /> Unified Board Policy Statement on Growth is attached to this letter. <br /> We appreciate any assistance the County can give school districts towards <br /> mitigation of the impact of new development, totheextent permitted by law. <br /> It is conceivable that the current law regarding school impact mitigation m a y <br /> change in the future to once again authorize counties to have greater <br /> participation relating to school facilities, and we belie�-e it is essential that t h e <br /> County retain language in its general plan that "to the extent permitted by <br /> law" the County will require new projects to mitigate impacts on school <br /> facilities. By retaining such language, the County will be in a position to assist <br /> with requiring mitigation from development projects for school facilities <br /> without first needing to complete a lengthy process to amend the general plan. <br /> Again, we thank you for the opportunity provided to comment on t h e <br /> proposed major subdivision.
