The Environmental Impact Report(EIR) addressed the following issues: visual and <br /> lighting; transportation and traffic; air quality and climate change; and noise. The EIR <br /> identified air quality and noise from off-site haul truck traffic as significant unavoidable <br /> adverse impacts. A Statement of Overriding Considerations was prepared to address <br /> significant unavoidable adverse impacts. <br /> The appellant is also appealing the Planning Commission's decision not to certify the <br /> EIR as adequate. <br /> The project site has a General Plan designation of A/G and OS/RC (General Agriculture <br /> and Open Space Resource Conservation) and is zoned AG-40(General Agriculture, 40- <br /> acre minimum). The site is located on the south side of River Road, at Harrold Avenue, <br /> near Escalon. <br /> Project Site History <br /> The existing quarry was originally permitted in 1957, and renewed under Excavation <br /> Permit EP-75-3. An EIR was prepared in 1975 (EIR-75-6). The permit was for the <br /> extraction of 1,500,000 cubic yards of sand and gravel. <br /> In 1981 Excavation Permit (EP-81-6) was approved by the Board of Zoning Adjustment <br /> for the removal of 500,000 tons of material over a five year period. <br /> On September 12, 1989, the Planning Commission approved Quarry Excavation <br /> application no. QX-89-0002, with an expiration date of August 31, 2009. <br /> On April 14, 1998, the Board of Supervisors approved Development Title Text <br /> Amendment TA-98-0001 to allow for the Continuation of an Accessory Use for an existing <br /> Quarry Operation if the resources are nearly exhausted or have been exhausted subject to <br /> the approval of a Revisions of Approved Actions Application. <br /> Pursuant to the approved Development Title Text Amendment, the applicant filed a <br /> Revisions of Approved Actions application to modify the Conditions of Approval to permit <br /> the continued operation of the authorized accessory uses. On March 4, 1999, the Planning <br /> Commission approved this application and also extended the life of the permit 30 years <br /> from the original date of approval, with an expiration date of March 4, 2029. Permitted <br /> Accessory Use(s) include an asphalt batch plant, storage silos, sand and gravel processing <br /> plant,truck scales, accompanying stockpiles, storage, offices, and shop. <br /> 2 <br />
