Findings <br /> The County finds that, pursuant to Section 15091(a)(3) of the CEQA Guidelines, specific economic, legal, <br /> social, technological, or other considerations make infeasible the mitigation measures identified in the Final <br /> EIR. <br /> Facts in Support of Findings <br /> Existing Plus Project Conditions <br /> Except where otherwise noted, impacts to the intersections listed below in the Existing Plus Project <br /> Conditions Table, all of which lie outside the County's jurisdiction, would be less than significant if the <br /> improvements recommended in the DEIR for each such intersection were constructed. However, the <br /> project alone does not cause the impacts in question. Rather, such impacts would be caused with or without <br /> the project. The project will therefore be required to contribute its fair share of the cost of the relevant <br /> improvements by paying the applicable fees for the project under the Regional Transportation Improvement <br /> Fee ("RTIF'� program at the time of building permit applications. Except where otherwise noted, the <br /> recommended improvements for the mitigation of these impacted intersections have been programmed for <br /> inclusion and construction under the RTIF program. <br /> However, the County, as Lead Agency,does not have jurisdiction over these improvements, and there are no <br /> other feasible mitigation measures apart from the payment of mitigation fees that are part of a reasonable, <br /> enforceable plan or program that is sufficiently tied to the actual mitigation of the traffic impacts at issue. <br /> Because it is uncertain whether full funding will be achieved for construction of these improvements, and,if <br /> so,whether and when such improvements will be constructed even with implementation of these mitigation <br /> measures, and therefore, whether these improvements will be constructed prior to project build out, these <br /> impacts will be significant and unavoidable even with implementation of the relevant mitigation measures. <br /> In addition, in the case of Impact TRANS-3, no feasible mitigation measure exists because only the <br /> installation of a traffic signal would mitigate this impact, however, the traffic signal warrants are not met for <br /> the installation of a signal. <br /> Findings of Fact/ 18 November 2012 <br /> Statement of Overriding Considerations <br />
