The second letter makes several conclusions based on a telephone conversation with <br /> the Community Development Department. <br /> 1. Applications of this type are normally approved, regardless of what neighbors think. <br /> • Approval of a Use Permit is based on making five Findings. All public <br /> comments are given serious consideration and compared to the Findings. <br /> The Findings are related to project impacts. If a Finding cannot be made in <br /> the affirmative, either the project is denied or a condition of approval is <br /> placed upon the project that reduces the impact to a level where the <br /> Finding can be made. <br /> 2. The winery is not required to provide sound walls or any sound control measures. <br /> Turn down amplified music at 8 p.m. so we can all get to sleep at a reasonable hour. <br /> We have a young child with an early bedtime. The music coming from a recent event <br /> continued to awaken my son who was trying to sleep_ <br /> • Development Title Section 9-1025.9 limits noise from stationary noise <br /> sources to an Hourly Equivalent Sound Level (Leq) of 50 dB or less and a <br /> Maximum Sound Level (Lmax) of 70 dB at the property line. Each of the <br /> noise level standards specified shall be reduced by 5 dB for impulsive <br /> noise, single tone noise, or noise consisting primarily of speech or music. <br /> The off-site wine cellar and the marketing events are located in the middle <br /> of a 22.7 acre lot. The nearest noise sensitive receptor (a residence) is <br /> more than 675 feet from the project buildings. Marketing events must end <br /> by 10:00 p.m. Outdoor amplified sound is permitted. No noise study is <br /> required because the noise generated from the marketing events is not <br /> expected to be above the maximum permitted levels. <br /> 3. No traffic impact studies are required. <br /> • The Public Works Department requires a traffic study for marketing events <br /> that have more than 150 participants. <br /> 4. There is no limit to how many people may attend the events. <br /> • Currently, the marketing plan states that there will be up to 24 events and <br /> that the events will average 150 people. If the applicant is planning on <br /> conducting marketing events with more than 150 attendees, then a traffic <br /> study will be required. In addition to marketing events, an applicant can <br /> apply separately for up to four Special Events per year. These Special <br /> Events may be larger than 150 people. <br /> 5. A helicopter landing pad is planned. Is this to transport partygoers"? Do not allow the <br /> helicopter pad. <br />
