Recommendations <br /> Action <br /> It is recommended that the Ptanning Commissiom <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-1000131 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies; standards; and raps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan; and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the establishment, maintenance and operation of a <br /> truck stop do not conflict with the General Plan. The use proposed in application PA- <br /> 1000131 is consistent with the Freeway Service General Plan designation, which in turn is <br /> permitted in the Freeway Service Commercial zone. The project will also be consistent <br /> with PA-0700226, the Flag City Special Purpose Plan. Projects that use the services of CSA <br /> 31 are subject to the Flag City Special Purpose Plan. The Flag City Special Purpose Plan <br /> includes design review regarding landscaping and parking. The Special Purpose Plan is <br /> implemented with the building permit. There are two other Special Purpose Plans in the <br /> vicinity. The project meets the requirements of Special Purpose Plan PP-98-0003, Thornton <br /> RoadlStar Road, regarding realignment and circulation and PP-94-0002 regarding a <br /> comprehensive sign plan. <br /> ,`ldequate utilities, ;orHdway Hnprove{1ae11ts saniL3tion, !nater srfpply. drainage, and other necessary <br /> facilities have been provided; and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, drainage <br /> and other necessary facilities will be provided and the proposed improvements are <br /> properly related to existing and proposed streets and highways. Public sewer, public <br /> water, and terminal storm drainage will be provided by CSA 31. <br /> hhe site is physically suitable for "the type of development and for the intensity of development_ <br /> • This Finding can be made because the property involved is of adequate size and shape to <br /> accommodate the proposed truck stop and all yards, building coverage, setbacks, parking <br /> areas and other requirements of this Title. This project will also meet the requirements of <br /> the Flag City Special Purpose Plan. <br /> Issuance of the permit will not be significantly detrimental to the pubtic health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties <br /> • This Finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts that could not be mitigated to a level of less <br /> than significant.
