However,mitigation couldp <br /> impact to a level considered less than significant. <br /> 9 <br /> 14.18 Mitigation Measure 9-American Badger <br /> implementation of the following mitigation would reduce impacts to American badger to a <br /> level considered less than significant. <br /> Thirty days prior to initiating work in a particular excavation area, a pre-construction survey <br /> should be conducted to determine the badger's presence or absence in that particular mining <br /> area. If badgers or their characteristic diggings are not identified during the pre-construction <br /> survey, no impacts to badgers would be expected to occur from mining in that area. . such, <br /> there wo-qld be no mitigation requirements. <br /> k <br /> If American badgers or their burrows are identified within a particular mining area,the burrows <br /> should-be flagged, and dependent upon the time of year work is scheduled to begin,one of the <br /> following two methods should be implemented to remove badgers from the site: (1)if <br /> construction would take place after July 1 and before March 1,one-way eviction boxes should be <br /> placed in the burrows to prevent death of individuals; or(2)if construction would take place <br /> between March 1 and July 1, during the time of year young are likely in the burrow and <br /> til <br /> dependent upon their mother,construction within 500 feet of shouldthen beaex eyed xcavated <br /> the young are old enough to leave the burrow. The <br /> project as currently proposed would impact..approximately 137 acres of suitable kit fox habitat. <br /> Potential impacts to kit fox from the proposed project include entrapment and eventual death of <br /> individual kit foxes in their burrows, collisions with earth moving equipment; and temporary loss <br /> (i.e., one to six years) of foraging and denning habitat. While no surveys for kit fox have been <br /> conducted on the project site, the project site is located at the eastern edge of what is known as <br /> the kit fox"Core Conservation Area," and numerous kit fox sightings have been documented in <br /> the immediate project site vicinity over the past 20 years. Additionally,on December 20, 1993, <br /> the applicant met with USFWS, CDFG, San Joaquin County,M&A,and others to discuss the <br /> 36 <br />
