I� <br /> E <br /> Biological Resources, MONS &ASSOCIATES <br /> impacts and Mitigations <br /> Tracy Facility Expansion Site <br /> on the next phase area of the mining project,until all six areas were surveyed. Each miring area <br /> (e.g., Area 1) and an area of influence around'the mining area would be surveyed. Surveys <br /> would commence within 60 days of initiation of mining. Preconstruction survey methods would <br /> include den surveys and use of surveillance cameras at questionable burrow sites. Prior to <br /> initiating surveys,proposed survey methods would be approved by USFWS and CDFG. In' <br /> addition, survey results would be prepared and submitted to USFWS and CDFG prior to <br /> initiation of mining that year. If no occupied Idt fox dens are located during surveys, then <br /> mining would be allowed to commence in that area. If occupied kit fox dens are located during <br /> preconstruction surveys, each den would be excavated by hand and animals removed and <br /> released nearby, outside the project area. Excavation activities would be coordinated with <br /> USFWS and CDFG personnel. Any occupied dens located outside the construction footprint <br /> would be clearly flagged and disturbance would be minimized to the greatest extent practicable. <br /> A biologist would also be posted near the occupied den to monitor activities and disturbance <br /> during construction. <br /> For complete details on the proposed kit fox mitigation plan, including a discussion of mitigation <br /> management fees,please refer to the San Joaquin Kit Fox Mitigation Pian in Appendix A, at the <br /> back of this report. Reclamation of the project site and acquisition of an offsite mitigation <br /> I parcel,in combination with preconstruction surveys,would reduce impacts to San Joaquin kit <br /> fox from the proposed project to a level considered less than significant. <br /> 14.21 Impact Number 11 -Waters of the United States and Stream Channels <br /> in Iemeiitation of the project.as proposed could result in impacts to waters of the United <br /> I P P <br /> . P P J <br /> States and stream channels. <br /> Corral Hollow Creek is the only"water of the United States"present on the project site. This <br /> stream channel meets the Corps criteria as an"other water." Impacts proposed to this stream <br /> channel include annual temporary installation and removal of a road crossing over a two year <br /> period. Installation of culverts to construct the road crossing would adversely effect <br /> approximately 0.03-acre-of"waters of the United States." Installation of these culverts would be <br /> considered a short-term significant impact. This impact could be mitigated to a level <br /> considered less than significant. <br /> 14.22 Mitigation Measure I1 -Waters of the United States-and Stream Channels <br /> Implementation of the following mitigation would reduce impacts to waters of the United <br /> States and stream channels to a level considered less than.significant. <br /> Installation of culverts in Corral Hollow Creek would require authorization from CDFG pursuant <br /> to Section 1603 of California Fish and Game Code, authorization from the Corps pursuant to <br /> Section 404 of the Clean Water Act,and receipt of a certificate or waiver of water quality from <br /> the Regional Water Quality Control Board pursuant to Section 401 of the Clean Water Act. <br /> Once these three agencies authorize/verify these agreements, culvert installation could take <br /> place. Since placement of the culverts in the creek would not impact riparian vegetation, and <br /> culvert installation and removal would occur during the dry months of the year, impacts to <br /> i <br /> 39 <br />
