41
5. The use is compatible with adjoining land uses.
This finding can be made because the proposed use will not interfere with nor alter the
current land;.uses on adjacent properties. The properties surrounding the project site are
zoned AG-40 and are being used for agricultural purposes. The nearest residence is located
400 feet av%i%y from the project site on the adjacent parcel to the north. As an ordinance
requirement; marketing events shall end at 10:00 p.m.
Williamson Act Compatibility Principles
(1) The use will not significantly compromise the long-term productive agricultural capability of the subject
contracted parcel or'parcels or on other contracted lands in agricultural preserves.
This Principle can be made because there is an existing 40-acre vineyard on-site that will
remain and-the revision will not displace any agricultural operations. The increase in
marketing events will solely be conducted outdoors and no new construction is proposed.
The uses on'the subject property will remain agricultural uses and will therefore not
significantly compromise the long-term productive capability of the subject contracted
parcel or other contracted lands in agricultural preserves.
(2) The use will not significantly displace or impair current or reasonably foreseeable agricultural
operations on the subject contracted parcel or parcels or on other contracted lands in agricultural
preserves. Uses that significantly displace agricultural operations on the subject contracted parcel or
parcels may be deerned compatible if they relate directly,to the production of commercial agricultural
products on the subject contracted parcel or parcels or neighboring lands, including activities such as
harvesting, processing, or shipping.
This Principle can be made because even though the proposed revision will increase the
number of marketing events, it will utilize an existing outdoor courtyard area and no new
buildings aee proposed..
(3)The use will not rdsult in the significant removallof.adjacent contracted land from agricultural or open-
space use. In evaluating compatibility a board or council shall consider the impacts on non-contracted
lands in the agricult4 al preserve or preserves.
• This Principle can be made because even though the proposed revision is to increase the
number of marketing events, the purpose is to promote wine grape growing and wine
making and.will encourage continued and expanded agricultural uses in the area. Therefore
it will not negatively impact agricultural uses on adjacent contracted lands and will not
result in the;significant removal of adjacent contracted land from agricultural or open-space
use.
A J
L.
I
F.
San Joaquin County,:,, PA-08001801Mencarini
Community Development Page 6
