Should be answered YES—This project will probably require approval of <br /> the Regional Water Quality.Control Board as it relates to establishing anew drain <br /> system'for.the.agricultural drainage.needed The existing drainagesystem is <br /> presently shared among at Ieast five land owners, with-land use changing to,poultry <br /> farming its-continued use is iiicoinpatible. Reclamation District 544 approval would <br /> be needed for any drainage improvements that.require.crossing or rhodification.to,the <br /> existing levee. This'.Initial Study answer is also Jcontadicted,on'Page 7'-where it states <br /> "This project has been refered to the Central Valley Regional Water Quality Control <br /> Board" <br /> Question 3. Is correctly answered YES—The City of Lathrop has annexed Stewart <br /> Tract which adjoins the project on the south side of Old River. <br /> Page 2. Environmental Impacts: <br /> Question l a. Should be answered YES —The project is most definitely located in a <br /> Federally Designated Flood Zone. Further significant portions of the project land <br /> - were partially underwater with levee seepage in the spring of 1997. Pictures of the <br /> property during 1997 flood events are attached. <br /> Page 3. Earth: <br /> Question 2b. Should be answered YES—Buildings constructed with the poultry farm <br /> project will need to be above 100 flood year levels. This will involve significant <br /> grading. Additionally, ponds for water discharge and sewage management of poultry <br /> operations will need to be graded and built to near 100 year levee standards so as not <br /> to be impacted by repetition of the levee seepage that occurred in the spring of 1997. <br /> Page 3. Plant/Animal Life: <br /> Question 3a. With information presently at hand this cannot be answered Yes or No <br /> as specific development plans for the project have not been submitted and specific <br /> disturbance of habitat cannot be determined. <br /> Question 3b. Should be answered YES—The Natural Diversity Data Base is <br /> incorrect. Swanson Hawks and Burrowing Owls (Endangered Species) are both <br /> known to be on or near the site. State of California representatives have banded and <br /> vaccinated Swanson Hawk chicks on our property located 1/2 mile west of the subject <br /> project. We don't know what the increased activity associated with poultry farm <br /> operations may have on the nesting and forage patterns of these endangered species. <br /> Page 3. Air/Climate: <br /> Question 4a. Should be answered YES--Very hard to conceive that poultry farm <br /> operations will not significantly contribute to the deterioration of existing air <br /> quality, they smell. Poultry farms upwind of planned residential housing <br /> development on Stewart Tract will subject those future residents to significant <br /> objectionable odors. <br /> Page 4.
