A ricultural Mitigation <br /> The Zone Reclassification would be subject to the Agricultural Mitigation Ordinance of the <br /> Development Title, The Ordinance requires agricultural mitigation for a Zone Reclassification that <br /> changes the permitted uses from an agricultural to a nonagricultural use. (Development Title <br /> Section 9-1080.3(a)(2)) Agricultural mitigation is satisfied by granting a farmland conservation <br /> easement or other farmland conservation mechanism as set forth in Subsection (d)of this Section <br /> to or for the benefit of a Qualifying Entity. The number of acres of agricultural mitigation land <br /> shall be at least equal to the number of acres that will be changed to a nonagricultural use [a 1:1 <br /> ratio]. (Development Title Section 9-1080.3(c)) Submission of the required legal instrument or <br /> payment of the in-lieu fee shall occur at the time of grading permit or building permit issuance for <br /> the underlying development project. (Development Title Section 9-1080.3(f) <br /> Options <br /> The Community Development Department has reviewed other available alternatives for the <br /> applicants to achieve their ultimate goal of establishing a cemetery on the project site to meet the <br /> needs of the community. These options are outlined as follows: <br /> 1. Development Title Text Amendment <br /> The current General Plan designation of RIL (Low-Density Residential) and Zone <br /> classification of AU-20 (Agriculture Urban Reserve, 20-acre minimum) would remain the <br /> same. An application for a Development Title Text Amendment would be submitted by <br /> the applicant to add the use type: Funeral and Internment Services, Cemeteries to the <br /> tables of uses in the R-L (Low-Density Residential) and AU-20 (Agriculture Urban <br /> Reserve, 20-acre minimum) zones (Development Title Tables 9-305.2 and 9-605.2, <br /> respectively), as a conditionally permitted use subject to an approved Use Permit <br /> application. <br /> Development Title Section 9-1105.3(b) states that within urban communities, <br /> "development projects on existing vacant parcels shall be served by a public wastewater <br /> disposal system. Exceptions for parcels over two (2) acres in size, and for parcels less <br /> than two (2) acres in size where the waste discharge will be limited to domestic waste <br /> only, may be granted subject to the provisions of Section 9-1105.2," <br /> Development Title Section 9-1120.3(c) states that within urban communities, <br /> "development projects on existing parcels shall be served by a public water system. <br /> Exceptions for parcels over two (2) acres in size may be granted, subject to the approval <br /> of the Environmental Health Department." <br /> Development Title Section 9-1135.3(b) states that within urban communities, <br /> "development projects on existing parcels shall discharge into a public terminal drain if <br /> �i one is within two hundred (200) feet of the nearest property line. If the existing parcel is <br /> not within two hundred (200) feet of such drain, a private on-site retention basin may be <br /> an acceptable alternative if: <br /> (1) The site conditions of soil permeability and ground water level allow a <br /> retention basin to meet San Joaquin County Improvement Standards, and; <br /> i! <br /> (2) The tributary watershed area to the retention basin is less than ten (10) <br /> I� <br /> acres, <br /> if the Development Title Text Amendment application is ultimately approved by the Board <br /> of Supervisors, the applicant could then submit a Use Permit application for the <br /> cemetery, which would be heard as a public hearing before the Planning Commission. <br /> i <br /> DC MEMO -2- PA-1100049 <br />
