Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-1100229 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the Funeral and Interment Services-Cemeteries use <br /> type may be conditionally permitted in the AU-20 (Agriculture Urban Reserve, 20-acre <br /> minimum) zone with an approved Use Permit application. The project site has a General <br /> Plan designation of R/L (Low-Density Residential). The proposed Cemetery presents no <br /> General Plan policy issues and is consistent with the goals,policies, standards, and maps <br /> of the General Plan. There are no Master Plan, Specific Plan, or Special Purpose Plan <br /> applicable for this site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because the project will be required to be served by an on-site <br /> well, septic system, and on-site retention basin. The Environmental Health Department is <br /> requiring a soil suitability/nitrate loading study indicating that the area is suitable for <br /> septic system usage. The construction of an individual sewage disposal system under <br /> permit and inspection by the Environmental Health Department is required at the time of <br /> development based on the San Joaquin County Sewage Standards and proposed <br /> population served. All new storm water runoff from the new construction shall be <br /> contained in a retention basin. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the 20-acre parcel is of adequate size and shape to <br /> accommodate the proposed use, building coverage, setbacks, and other requirements of <br /> the Development Title. The Site Plan shows that there is sufficient area for parking and <br /> circulation, in compliance with Standards of the Development Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safely, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because the Initial Study prepared for the project found no <br /> potentially significant environmental impacts. <br /> San Joaquin County PA-1100229/Zambetti <br /> Community Development Page 4 <br />
