t'{
r _
Recommendations =
Action
It is recommended that the Planning Commission:
I. Approve the Negative Declaration;and
2. Approve Use Permit No.UP-00-24 with the Findings and Conditions of Approval contained in
the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan;
any applicable Master Plan, Specific Plan, and Special Purpose Plan; and any other applicable plan
adopted by the County.
• This finding can be made because Food Processing may be conditionally permitted in the
AG-160 zone with an approved Use Permit. The AG-160 zone is an implementing zone for
the A/G General Plan designation. No other plans apply.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
This finding can be made because the site has access to Via Nocolo Road, and there is
sufficient area for process water treatment ponds and on-site drainage and sewage
disposal,as shown on the site plan.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because adequate area exists for the required processing
ponds,storm drainage ponds (if required),septic systems, parking, and driveways.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be
injurious to the property or improvements of adjacent properties.
This finding can be made because this site is bordered on all sides by grazing land.
RWQCB review and approval of the process water pond will ensure that odors do not
significantly affect a residence located approximately 315 feet from the proposed pond.
5. The use is compatible with adjoining land uses.
• This finding can be made because this site is bordered on all sides by grazing land.
RWQCB review and approval of the process water pond will ensure that odors do not
significantly affect a residence located approximately 315 feet from the proposed pond.
San Joaquin County UP-00-241Studley Company
Community Development Page 4
