UP-00-24 OF MUSCO OLIVE PRODUCTS, INC. (CIO EDWARD MA). The project is the expansion of an existing olive processing facility by the construction of a retention pond for the storage of olive process waste water, and the construction of an additional concrete slab for addition olive storage tanks. The pond is approximately 12 acres in size and the slab is approximately six acres in size. The site is located at the end of Via Nicolo Road, 3,000 feet west of Hansen Road, southwest of Tracy. The Initial Study prepared for this project indicates that this project could have a potentially significant impact on the San Joaquin Kit Fox and the Burrowing Owl unless specified mitigation S p measures are adopted as conditions of approval of the project. Those mitigation measures are included in the Conditions of Approval recommended below. Those mitigation measures may be modified when comments are received from the Department of Fish and Game or the U.S. Fish and Wildlife service. The proposed negative declaration was submitted to the State Clearing House for circulation. The SCH review ends on or around January 27, 2001. This item is tentatively scheduled for the Planning Commission meeting of February 1, 2001. The Community Development Department intends to recommend approval with the following conditions: Use Permit Application No. was approved by the Planning Commission on . This approval will expire on , which is 18 months from the effective f date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been issued and remain in force, and (3) all necessary permits from other agencies have been issued and remain in force. Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits.
