I. COMPLIANCE DATES: Because this development is currently operating without the <br /> required permits and approvals, the owner shall comply with the following deadlines, <br /> except as otherwise stated in the Conditions of Approval: <br /> (1) The required Site Plan and any other permits required for the approval shall be <br /> submitted within 30 days of the effective date of the application's approval. <br /> (2) All required improvements shall be installed within 90 days of the effective date <br /> of the application's approval. <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Staff Contact: Tom W. Iwamiya, 468-3023): <br /> a. DRIVEWAY IMPROVEMENTS: The driveway approach shall be improved in accordance <br /> with the requirements of San Joaquin County Standard R-17 prior to issuance of the <br /> occupancy permit. (Development Title Section 9-1145.5) <br /> b. ENCROACHMENT PERMIT: An encroachment permit shall be required for work within <br /> the road right-of-way. (Development Title Section 9-1145.2) <br /> C. ROADWAY DEDICATION: The owner shall execute an Irrevocable Offer and Agreement <br /> to Dedicate a right-of-way that conforms to minimum San Joaquin County standards for <br /> horizontal curves along Walnut Grove Road. A $225.00 fee currently is required for <br /> processing, per Development Title Table 9-240.2, in addition to a copy of the Grant Deed, <br /> a recording fee, and a legal description of the parcel to be offered for dedication. <br /> d. FRONTAGE IMPROVEMENTS: The frontage improvements for Walnut Grove Road shall <br /> be constructed in conformance with the standards for one-half of an 84-foot-wide right-of- <br /> way Rural Arterial Road. The construction of the frontage improvements will be deferred <br /> upon execution by the owner of a Deferred Frontage and Roadway Improvement <br /> Agreement or a Secured Deferred Frontage and Roadway Improvement Agreement with <br /> a deposit equivalent to the estimated construction costs prior to approval of the <br /> Improvement Plan. A $260.00 fee currently is required for processing, per Development <br /> Title Table 9-240.2, in addition to a copy of the Grant Deed, a recording fee, legal <br /> descriptions of the property, and an estimate. The estimate and legal descriptions shall <br /> be prepared by a Registered Civil Engineer with a typical section drawing on a form to <br /> be supplied by the Department of Public Works and submitted to Public Works for <br /> approval. As an option, Public Works will prepare the drawing and estimate for an <br /> additional fee of $115.00. This development may be subject to reduced frontage <br /> improvement requirements depending on the Ordinance requirements in effect at the time <br /> of building permit application. (Development Title Section 9-1100.3) <br /> e. TRAFFIC FEE: The Traffic Impact Mitigation Fee will be required for this development. <br /> The fee is due and payable prior to approval of the improvement plan. The fee currently <br /> is $631.00 per 1,000 gross square feet of building designated as 'Manufacturing' or <br /> $164.07 per daily trip-end generated in the Thornton area. The fee shall be automatically <br /> adjusted July 1 of each year by the Engineering Construction Cost Index as published <br /> by the Engineering News Record.
