CLEANUP AND ABATEMENT ORDER <br />CALIFORNIA TANK LINES, INC. <br />SAN JOAQUIN COUNTY <br />-2- <br />8. Water samples in Walker Slough at the point of discharge contained 348.5 <br />mg/1 of copper with a hardness of 69.99 mg equivalent CAC03/1. An upstream <br />water sample contained only 0.8 mg/l copper. A water sample from the <br />earthen ditch within 30 feet of the site was a very bright aqua blue color <br />and contained 3,214 mg/1 copper. The Ambient Water Quality Criteria (EPA) <br />to -protect fresh water aquatic life based on a hardness value of 69.99 mg <br />equivalent CAC03/1 and one-hour average is 8.75 ug/1. <br />9. Chromium and other heavy metals were also detected in the site drainage and <br />in Walker Slough, at the point of discharge, at levels exceeding upstream <br />levels. <br />10. The Discharger has caused a condition of pollution and continues to cause, <br />or threatens to cause, surface water pollution. <br />11. Section 13304(a) of the California Water Code provides that: "Any person... <br />who has caused or permitted, causes or permits, or threatens to cause or <br />permit any waste to be discharged or deposited where it is, or probably <br />will be, discharged into the waters of the state and creates, or threatens <br />to create, a condition of pollution or nuisance, shall upon order of the <br />Regional Board cleanup such waste or abate the effects thereof, or in the <br />case of threatened pollution or nuisance, take other necessary remedial <br />action..." <br />12. Issuance of this Order is exempt from the provisions of the California <br />Environmental Quality Act (Public Resources Code Section 21000, et seq.) in <br />accordance with Section 15321(a)(2), Chapter 3, Title 14, of the California <br />Administrative Code. <br />IT IS HEREBY ORDERED that pursuant to the California Water Code, California Tank <br />Lines, Inc., and Chemical Transfer Company shall cleanup and abate pollution <br />and threatened pollution by taking the following actions under the direction of <br />a California Registered Civil Engineer: <br />1. By 30 March 1987 cleanup: <br />a. The contaminated bank soils and vegetation that is exposed during low <br />tides and flooded during high tides.* <br />b. The drainage system leading from the site to Walker Slough. If this <br />cannot be accomplished, an alternate drainage system must be provided. <br />* Contaminated bank soils and vegetation are those that have been contaminated <br />by the discharge from the culvert. <br />
