I have reviewed SB 562, the <br /> RWQCB notice of reimbursement responsibility, and the EAR Chapter 19 <br /> procedure which is located in the 75 E Alpine file. I believe that a non-emergency <br /> status is a viable option to obtain closure for these sites. <br /> SB 562 Section 25299.53 <br /> a) If an owner is not taking corrective action the local agency shall submit the <br /> estimated cost of the corrective action to the board. <br /> b) If the board approves the request the local agency may pay for the costs of <br /> corrective action performed by qualified contractor. <br /> c) The board shall not make any payment unless the board determined that the <br /> responsible party has failed to comply with a final order for corrective action <br /> issued pursuant to section 25299.37 <br /> d) Upon making any payment to a local agency the board shall recover the <br /> amount of payment pursuant to section 29299.55 <br /> RWQCB Notice of Reimbursement Responsibility <br /> Once EAR Account funds are expended, owners and operators lose their <br /> eligibility to participate in the Underground Storage Tank Cleanup Fund Program <br /> Emergency Abandoned and Recalcitrant sites <br /> Water Quality Chapter 19 <br /> Contact UST Cleanup Fund Program Diane Edwards Voice 916 227 4383 <br /> Fax 916 227 4530 <br /> Regional Water Boards upon request from SWRCB notifies LIAs to nominate <br /> sites for inclusion on the regional annual list of abandoned and recalcitrant sites <br /> for EAR Account funding.
