1 Winston tl l83 <br /> Stockton,CA <br /> ' August 8,2002 <br /> 7.0 REGULATORY REVIEW <br /> ' A review of environmental regulatory agency database listings was obtained from Track Info <br /> Services/Environmental First Search of San Diego, California. The purpose of the review was to identify <br /> reported environmental issues for the Site and other properties in the vicinity. First Search utilized a maximum <br /> ' one-mile search distance for each of the referenced federal and state environmental databases,as per ASTM <br /> Standards. <br /> ' SECOR reviewed the results of the database search report to note reported release sites in the vicinity of the <br /> Site that were considered to have a potential to have adversely impacted the Site. Reported release sites <br /> identified in the regulatory agency database search report were evaluated with respect to information provided <br /> ' about the nature and extent of a given release, the distance of the reported release from the Site, and the <br /> position of the reported release with respect to known or expected local groundwater flow direction. Generally, <br /> reported release sites located within 114-mile upgradient, 118 mile cross-gradient, or located on adjacent <br /> downgradient properties would be considered to have4 potential to have impacted the Site. Sites that lAere <br /> listed in the database search report,but not identified as a release site(for example a site listed as a hazardous <br /> waste generator but not having had a release),and sites that were listed as being"closed,"were not considered <br /> ' to have a potential to impact the Site. The environmental database report provided by First Search is included <br /> as Appendix C. <br /> ' The Site is included on two of the environmental databases searched. <br /> • Winston Tire Company appears on the Emergency Response Notification System(ERNS)database. <br /> According to the First Search database report,a hose broke on a delivery truck during a delivery of <br /> ' bulk motor oil to the Site in May 2000. Approximately 15 gallons of oil spilled onto the pavement. <br /> The Fire Department Hazardous Material Cleanup crew was called and the product was collected <br /> using absorbent materials. No documentation was found on file with City of Stockton Fire <br /> ' Department to further collaborate this incident and no evidence of the spill such as stains on the <br /> pavement were noted during SECOR's site visit. <br /> ' • Winston Tire Company appears on the RCRA Generator Site database. The Site is listed as a <br /> generator of between 100 and 1,000 kilograms per month of hazardous waste.
