With respect to the <br /> monitoring wells installed on the property, Nestle shall in its <br /> sole discretion and at its Zole cost and expense either maintain <br /> and Utilize the wells as monitoring wells or abandon such wells <br /> in accordance with the applicablc procedures established by the <br /> Calitornia oepartment Uf Water Resources, the California Regional <br /> Water Quality control SOard, Cer,Lral Valley Region, and the- San <br /> Joaquin County Department of Health. <br /> C. Regal retains the right to terminate Nestle ' s right of <br /> entry in the event Nestle conducts work beyond the scope set <br /> forth in the approved work plan or Nestle Lails to conducts its <br /> work in accordance with the time scnedule set forth in the work <br /> plan referenced in paragraph I .A. <br /> III . Disclosure of Results <br /> Nestle shall keep Regal informed as to its activities on the <br /> property and shall provide Regal, for all soil , soil gas. .and <br /> groundwater samples taken from the property, with copies of all <br /> field measurements and test results or analyses within 3Q days <br /> after the measurements, results, or analyses have been <br /> prepared. Nestle shall also provide Regal with splits or all <br /> samples taken during the work on the property. Nothing in this <br /> Agreement shall constitute a waiver of the attorney-client or <br /> attorney work-product privileges with respect to any analysis <br /> performed for the purpose of litigation by or at the direction at <br /> 4. <br />
