Department of Health Services (DHS), a predecessor to DTSC, DHS conducted an <br /> inspection at the site. The inspection revealed that Mr. Gordon was conducting <br /> activities for which he did not hold the required permits. <br /> 2.3.1 .2 By December 1985, DHS inspections found that most of the chemicals <br /> were removed from the Site. <br /> 2.3.1.3 From 1984 through 1986 the San Joaquin District Attorney's Office in <br /> conjunction with DHS conducted enforcement actions which resulted in chemicals being <br /> removed from the property. In 1986; the San Joaquin County Superior Court issued a <br /> permanent injunction which prohibited Larry Gordon, dba Gordon Research Company, <br /> dba U.S. Gordon Subproperty from handling treating, storing, or disposing of hazardous <br /> substances/wastes. A copy of the permanent injunction is included as Exhibit C. <br /> 2.3.1.4 In 1988, a joint inspection of the Site was conducted by DHS staff, the <br /> Manteca Fire Department, and the county District Attorney's office. At the time of the <br /> inspection, a portion of the property was surrounded by a fence. Within the fenced area <br /> 10-20 drums were noted. Mr. Gordon claimed that the drums contained product used in <br /> the course of his business. Mr. Gordon stated that he was no longer purchasing <br /> chemicals from military surplus auctions, although the inspectors noted the drums <br /> appeared to have marking similar to military specifications. Mr. Gordon stated he did <br /> purchase surplus equipment or surplus parts from military auctions which were re-sold <br /> at auctions that were conducted at the property. <br /> 2.3.1.5 In October of 2007, San Joaquin County Environmental Health <br /> Department Officials inspected the Site and found the containers and high-pressure <br /> cylinders present at the Site. Open containers with handwritten notations were <br /> observed. All of the containers have been exposed to the elements some of them have <br /> deteriorated and are leaking. In response to directives from the Environmental Health <br /> Department the Respondent has cleared the eastern portion of the Property <br /> approximately. The Respondent has also removed asbestos containing material from <br /> the residence. There is some fencing currently in place at the Site. Respondent placed <br /> Page 4 of 25 <br />
