LINCOLN STREET, STOCKTON, <br /> SAN JOAQUIN COUNTY, CALIFORNIA <br /> On 5 October 2007, the Regional Board Executive Officer issued Cleanup and Abatement <br /> Order No. R5-2007-0725 (CAO), pursuant to Water Code Sections 13304 and 13267, <br /> directing you to submit quarterly monitoring technical reports. The CAO requires quarterly <br /> sampling and analyses reports for all wells installed for investigation and remediation, per the <br /> CAO schedule, and submittal of the quarterly reports by the first day of the second month <br /> following that quarter (e.g., 1 February 2009). The Quarterly Groundwater Monitoring Report, <br /> Fourth Quarter 2008 (4Q2008), submitted 4 February 2009, states that offsite groundwater. <br /> wells MW--14; MW-a5,-MWA7,-anti-M-W-'!9 were inaccessible and-were not sampled (and no <br /> groundwater wells data will be forthcoming) during the fourth quarter of 2008, which is a direct <br /> violation of the CAO. Regional Board staff (staff) reviewed the paper copy of a document that <br /> your consultant, Stratus Environmental, Inc. (Stratus) submitted and identified as the 4Q2008. <br /> The document was submitted on 4 February 2009. The submitted document was found to be <br /> incomplete for lack of the above mentioned required groundwater sampling and analyses data. <br /> In addition, the failure to conduct the required monitoring well sampling during the fourth <br /> quarter of 2008 was not reported to staff prior to the submittal of the incomplete <br /> 4 February 2009 document. During the last two months, staff has communicated with Stratus <br /> and Timothy Kong to resolve the offsite access issues with the neighboring property. On <br /> 20 March 2009, staff conducted a site inspection during the first quarter 2009 sampling event, <br /> and was assured by Stratus that all wells would be sampled that quarter. On 28 April 2009, <br /> staff received the Quarterly Groundwater Monitoring Report, First Quarter 2009 (1 Q2009) <br /> report that states, in addition to one of the offsite wells (MW-15) not sampled during the <br /> previous quarter, three of the onsite wells (MW-2, MW-5, and MW-6) were also inaccessible <br /> and not sampled (and no groundwater wells data will be forthcoming), for a total four wells not <br /> California Environmental Protection Agency <br /> QiRecycled Paper <br />
