Dolly Madison/Langendorf 2 _ 30 April 2009 <br /> 1426 S. Lincoln St., Stocktc,,,,,r <br /> sampled during the first quarter of 2009. Although the 1 Q2009 report does not explain why <br /> the wells were inaccessible, Stratus responded to an 8 April 2009 staff email request for the <br /> status of the monitoring wells in question. The 9 April 2009 Stratus email response stated that <br /> the onsite wells that were reported (and observed by staff) covered by soil stockpiles during <br /> the Site Inspection (due to the construction of the Soil Vapor Extraction/Air Sparging <br /> Treatment System), could not be sampled before the end of the first quarter 2009 due to soil <br /> contamination discovered in the soil stockpiles that required special handling prior to removal <br /> to an approved landfill. Also, the offsite well (MW-15) could not be sampled due to a <br /> construction vehicle wheel parked on top of the well, which was not moved by the owner as <br /> requested on 20 March 2009. <br /> As of 1 May 2009, 59 days have passed since the established CAO report due dates for one <br /> complete report (4Q2009) and the due date for a second complete report is tomorrow <br /> (1 Q2009). Therefore, you are in violation of the CAO Order, and, pursuant to Water Code <br /> Sections 13350 and 13268, are subject to civil liabilities (fines) of up to $5,000 for each day in <br /> which the violation occurs and up to $1,000 per day for each overdue report. <br /> The complete 4Q2009 monitoring report is currently overdue by 59 days. Based on the <br /> number of days you are in violation (59) of the CAO, and you can be held liable for a <br /> maximum administrative civil liability (using $1,000/day) of $ 59,000. <br /> Please correct the above discussed conditions that Stratus has stated was the cause of the <br /> violation to the CAO, and submit documentation of said correction by 5 May 2009. Failure to <br /> comply with this request will result in staff recommend ing.the issuance of an Administrative <br /> Civil Liability Complaint (fines). All considerations for an administrative economic liability will <br /> be based on the original due dates listed in the CAO. In addition, compliance with Regional <br /> Board directives is a condition of eligibility for acceptance into the UST Cleanup Fund and for <br /> receiving reimbursement for incurred costs.
