Charter Way, Stockton Program: HW SUMMARY OF VIOLATIONS CLASS I, CLASS II, or MINOR -Notice to Comply) 27. A 5 gallon bucket of skimmer/cleaner waste was observed in the prep shop without a lid. All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close this container and ensure all hazardous waste containers are closed when not adding or removing waste. REPEAT VIOLATION 31. A tank assessment was not available on site for the used oil and used antifreeze tanks. A copy of the used oil tank assessment was submitted to the EHD on March 23, 2010. A hazardous waste generator shall obtain and keep on site a written assessment for each hazardous waste tank at the facility. This assessment shall be reviewed and certified by an independent, qualified, professional engineer, registered in California, and shall attest to the tank system's integrity. The assessment shall determine that the tank system is adequately designed and has sufficient structural strength and compatibility with the waste stored, and shall be written in accordance with Title 22 regulations. Immediately obtain a written tank assessment for all hazardous waste tanks at this facility in accordance with Title 22 regulations, maintain copies on site at the facility, and submit a copy of the certified assessment for the used antifreeze tank to the EHD. REPEAT VIOLATION 45. The contingency plan for this facility included the local agency and hospital information for Stanislaus County. This facility is located in San Joaquin County. A contingency plan shall include all of the following: -actions facility personnel shall take in response to fires, explosions, and unplanned release to air, soil, or surface water -arrangements agreed to by local police departments, fire departments, hospitals, contractors, and state & local emergency response teams -names, addresses & phone numbers (office & home) of the Emergency Coordinator -list of all emergency equipment at the facility (fire, spill, communications/alarms, decon), including location, physical description, and a brief outline of its capabilities -evacuation plan, including routes and signals to be used -telephone number of Cal EMA This information must be kept current at all times. Immediately update the contingency plan for this facility to include all of the necessary information and submit a copy of the updated plan to the EHD by March 12, 2011. REPEAT VIOLATION ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122).
