Charter Way, Stockton <br />Program: HW <br />SUMMARY OF VIOLATIONS <br />CLASS I, CLASS II, or MINOR -Notice to Comply) <br />60, 61, & 62. Manifest numbers 005923360JJK (12/23/09), 005547514JJK (2/19/09), 000516430JJK <br />(2/18/09), 000516429JJK (2/18/09), and 004090036JJK (4/15/08) were not found on site. Hazardous <br />waste generators shall retain copies of all manifests for three years or until a copy signed off by the <br />destination facility is received. The signed off copy shall be retained and made readily available for <br />review for three years. If the generator did not receive a copy of the manifest with the handwritten <br />signature of the owner or operator of the facility to which the generator's waste was submitted within 35 <br />days of the date the waste was accepted by the initial transporter, the generator shall contact the <br />transporter and/or the owner or operator of the designated facility to determine the status of the waste. <br />If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date <br />that the waste was accepted by the initial transporter, the generator shall submit an Exception Report <br />that includes a legible copy of the missing manifest, and a cover letter signed by the generator <br />explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports <br />shall be submitted to: <br />DTSC Report Repository <br />Generator Information Services Section <br />P.O. Box 806 <br />Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. <br />By March 12, 2011, submit to the EHD a copy of the signed off copy of the manifests or a copy of the <br />exception report submitted to DTSC. <br />REPEAT VIOLATION <br />64. Copies of spent lead acid battery disposal records were not found on site. The generator shall retain <br />on site a legible copy of each manifest or bill of lading which identifies spent lead acid batteries shipped <br />to a person who stores, uses, reuses, recycles, or reclaims the batteries or their components. <br />Immediately locate a copy of all disposal records for spent lead acid batteries for the last three years, <br />maintain them on site, and submit copies to the EHD by March 12, 2011. <br />REPEAT VIOLATION <br />85. Copies of universal waste disposal records for alkaline batteries and electronic devices were not <br />found on site. A generator of universal waste shall keep a record of each shipment of universal waste <br />on site for at least three years. The record may take the form of a log, invoice, manifest, bill of lading, or <br />other shipping document, and shall include the following: <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122). <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />Received By: <br />Title: <br />EHD 23-02-003 ( v /10/10 CONTINUATION FORM <br />
