❑� Northwest Pipe Spill Prevention, Control, and Countermeasure (SPCC) Plan 2 <br /> �--. Company Tracy Plant <br /> 1.2 General Applicability and SPCC Plan Preparation Requirement <br /> The Tracy Plant is a non-transportation related on-shore facility captured under both <br /> 40 CFR § 112 and the Aboveground Petroleum Storage Act or APSA: <br /> x❑ The Tracy Plant was operating on or before August 16, 2002 [40 CFR § <br /> 112.3(a)(1)]. <br /> ❑ Oil and oil products are stored, transferred, distributed, used, or consumed <br /> at the Tracy Plant. The Tracy Plant could reasonably be expected to <br /> discharge oil in quantities which may be harmful into or upon the navigable <br /> waters of the United States [40 CFR § 112.1(b)]. The term "navigable <br /> waters" includes coastal waters and inland surface waters (ponds, lakes, <br /> rivers, creeks, etc.). In general, if a discharge of oil can reach a storm <br /> drain, dry creek, or dry wash, it is reasonable to assume that the discharge <br /> can reach "navigable water". <br /> x❑ The aggregate aboveground oil storage capacity of the facility is greater <br /> than 1,320 U.S. gallons [40 CFR § 112.1(d)(2)(ii) and HSC § 25270.3] <br /> The Tracy Plant has an aggregate aboveground oil storage capacity greater than <br /> 10,000 U.S. gallons. It cannot be considered a Tier 1 or Tier 2 qualified facility as <br /> described in 40 CFR§ 112.3(g). Tier 1 is for facilities with no individual tank larger than <br /> 5,000 gallons. Tier 2 is for facilities which have not had a previous spill, essentially; <br /> and have an aggregate aboveground oil storage capacity of 10,000 gallons or less. <br /> Therefore, this SPCC Plan has been prepared to conform to the applicable provisions <br /> of 40 CFR § 112.3(d), 112.7, and 112.8 which will be called a "certified" SPCC Plan. <br /> The owner or operator of a facility subject to this part must prepare a Plan in <br /> accordance with good engineering practices. The Plan must have the full approval of <br /> management at a level of authority to commit the necessary resources to implement <br /> the Plan fully. Every attempt has been made to follow the sequence specified. <br /> This SPCC Plan includes a section cross-referencing the location of requirements listed <br /> in 40 CFR §112.7 and those required elements in this SPCC plan (Appendix A). As <br /> detailed elsewhere in this plan, how this facility conforms with or intends to comply with <br /> all applicable SPCC Plan requirements are included. <br /> 1.3 SPCC Plan Organization and SPCC Rule Cross Reference <br /> This SPCC Plan has been organized to facilitate implementation of the plan by Tracy <br /> Plant management. While this document contains all necessary SPCC Plan and APSA <br /> elements, it may not follow the exact SPCC Plan sequence specified in 40 CFR§ 112.7. <br /> As stated above, Appendix A contains a cross-reference table which links the federal <br /> regulatory requirements (and APSA or HSC §25270 et seq. by reference) with the <br /> corresponding section(s) of this SPCC Plan. <br />
