Spill Prevention,Control,and Countermeasures Plan <br /> City of Ripon <br /> Fueling Station <br /> Page 7 <br /> • State law requires that any discharge or threatened discharge of oil into state waters must be <br /> reported to Cal OES [California Government Code(GC)section 8670.25.5;California Water Code <br /> (WC) section 132721 <br /> • If the release of oil is on land and is not discharged or threatening to discharge into state waters; <br /> and (a) does not cause harm or threaten to cause harm to the public health and safety, the <br /> environment,or property; and(b)is under 42 gallons,then no notification to the Cal OES/Warning <br /> Center is required. <br /> California State law required hazardous material release notifications: <br /> Upon discovery, report "any release or threatened release of a hazardous material to the <br /> administering agency and the California Emergency Management Agency2, if there is reasonable <br /> belief that the release or threatened release poses a significant or potential hazard to human health <br /> and safety,property, or the environment"(California Code of Regulations, Section 2631). <br /> Definition of hazardous material/hazardous substance: <br /> (1)Any material that,because of its quantity,concentration,or physical or chemical characteristics, <br /> poses a significant present or potential hazard to human health and safety or to the environment <br /> if released into the environment,including,but not limited to,hazardous waste and any material <br /> that the administering agency or a handler, as defined in Chapter 6.91 (commencing with <br /> Section 25410) of Division 20 of the Health and Safety Code, has a reasonable basis for <br /> believing would be injurious to the health and safety of persons or harmful to the environment <br /> if released into the environment. <br /> (2)Any substance or chemical product for which one of the following applies: <br /> (A)The manufacturer or producer is required to prepare a MSDS,as defined in Section 6374 of <br /> the Labor Code,for the substance or product pursuant to the Hazardous Substances Information <br /> Training Act(Chapter 2.5 (commencing with Section 6360)of Part 1 of Division 5 of the Labor <br /> Code) or pursuant to any applicable federal law or regulation. Subsections (B) and (C) have <br /> been removed.The sections describe radioactive materials,which would not typically be subject <br /> to the SPCC requirements. (D) The materials listed in subdivision (b) of Section 6382 of the <br /> Labor Code. <br /> Facility personnel are to send local and state agencies (e.g. local fire department, CUPA, and Regional <br /> Board) a complete copy of all information provided to the EPA Regional Administrator. Upon receipt of <br /> the information, such local or state agencies may conduct a review and make recommendations to the EPA <br /> Regional Administrator as to further procedures,methods, equipment, and other requirements necessary to <br /> prevent and to contain discharges from the Facility. The Reporting Petroleum (Oil) Releases and Spill <br /> Notification Matrix fact sheets provided by Cal OES are included in Appendix 2. The Facility spill history <br /> is included in Appendix 3. <br /> 1.2.7 Spill Response [40 CFR 112.7(a)(5); 40 CFR 112.4(a)] <br /> Spill Response Plan and Reporting Forms are contained in Appendix 4.Facility personnel are to notify the <br /> Response Coordinator of any spills. Additionally, personnel trained to perform minor spill cleanup are to <br /> be available for minor spill control as necessary. Spill control and clean-up materials are to be maintained <br /> at the Facility. Spill kit locations are shown in Figure 3, Facility Diagram. A large spill may require the <br /> services of a qualified removal and disposal contractor to clean up the spilled material. <br /> 2 On July 1, 2013, the California Emergency Management Agency was reorganized into the California Office of Emergency <br /> Services. <br /> �i� CONDOR <br />
