Section 66490 - GSA disposed of a hazardous waste on land at a site <br />which did not have an appropriate Hazardous Waste Facility Permit <br />issued by the Department. <br />5. Section 66505(a -b) - GSA failed to make a hazardous waste determina- <br />tion. <br />6. Section 66505(c) - GSA failed to take steps to ensure that hazardous <br />waste generated at the facility was taken to a facility permitted by <br />the Department to accept such waste. <br />C. Title 40, Code of Federal Regulations (Authority for Enforcement Given <br />in Section 25159.7, H&SC) <br />1. Section 262.11 - GSA failed to make a hazardous waste determination on <br />its waste streams. <br />2. Section 262.20 and 262.21 - GSA failed to manifest hazardous waste <br />being transported off-site. <br />3. Section 262.34(a) - GSA failed to label and remove hazardous waste from the <br />facility for proper disposal within 90 days of generation of the waste. <br />4. Section 262.34(b) - GSA is operating an on-site hazardous waste storage <br />facility without a Hazardous Waste Facility Permit, and without com- <br />plying with the requirements of 40 CFR, Parts 264 and 265 and the per- <br />mit requirements of 40 CFR, Part 122. <br />5. Section 262.40(a) - GSA failed to maintain copies of manifests on-site <br />for at least three years from the date the wastes were accepted by the <br />initial transporter. <br />6. Section 262.41 - GSA failed to prepare bi-annual reports as required. <br />7. Section 262.42 - GSA failed to file a manifest exception report as <br />required. <br />8. Section 265.16 - GSA failed to provide personnel training in hazardous <br />waste management procedures and failed to maintain documents and records <br />of the training at the facility as required. <br />9. Section 265.31 - GSA failed to maintain and operate the facility in a <br />manner to minimize the possibility of any sudden or non -sudden release <br />of hazardous waste or hazardous waste constituents. <br />10. Section 265.32(c) - GSA failed to equip the facility with spill control <br />equipment as required. <br />
