Development Committee -2- GX-94-3 1. COMMUNITY DEVELOPMENT DEPARTMENT: a. The average finished grade elevation shall be no lower than 30. 9 feet. (Development Title Section 9- 1410. 3 [b] [4] ) b. All Conditions of Approval shall be complied with and grading shall have commenced within eighteen (18) months of the date of approval of GX-94-03 . Excavation and final rehabilitation of the site shall be completed within eighteen (18) months of the start of excavation. (Development Title Section 9-215. 14) C. All private roads involved in the excavation shall be maintained so as to control the creation of dust. Dust control measures and haul roads shall be included on the Improvement Plan. (Planning Title Section 9-1410. 3 [a] ) d. Provide certification of approval of proposed final grades from the Bret Harte Water Users and the South San Joaquin Irrigation Districts prior to authorization being given to commence the grading excavation. (Development Title Section 9-1410. 3 [b] [2] ) e. Excavation operations shall not be carried on during the hours from nine (9) p.m. through five (5) a.m. , except during periods of declared national, state or local emergency. (Development Title Section 9-1410. 3 [d] ) f. All emissions shall be subject to the rules and regulations of the San Joaquin Valley Unified Air Pollution Control District. (Development Title Section 9-1410. 3 [f] ) g. If noxious weeds are on the site, operations shall be in accordance with instructions from the Agricultural Commissioner of San Joaquin County. (Development Title Section 9-1410.3 [h] ) h. Any night lighting established on the property shall be arranged and controlled so as not to illuminate public rights-of-way or adjacent properties. (Development Title Section 9-1410. 3 [e] ) i. Excavations shall not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitos, rodents, or other pests.
