You explain that Kleinfelder, Inc.
(Kleinfelder) submitted on 30 April 2002 a report on the installation of 13 wells; a proposal on 26
September 2002 to install three additional monitoring wells in the vicinity of the new storage reservoir;
and a work plan on 29 October 2002 for conducting additional hydrogeologic investigation, replacing
monitoring well no. 9, and installing pan lysimeters. Regional Board staff provided comments to Musco
on the latter work plan and requested additional information, but did not copy Kleinfelder. You indicate
that Musco was not aware of the oversight and that Kleinfelder's response to the request was delayed
until 18 March 2003. Regional Board staff in the Fresno office, which now has oversight over this
discharge, has not yet responded to Meinfelder's 18 March addendum. You also state that soil moisture
data now being collected should provide valuable information for selecting the most suitable locations
for pan lysimeter installation.
An extension cannot be granted to the 1 May 2003 deadline stipulated in Provision G.2.h of the WDRs
except by Regional Board action. However, your request for more time appears reasonable under the
circumstances and staff will initiate no enforcement action over this delay provided the Groundwater
Well and Lysimeter Installation Report is submitted by 8 September 2003. It is imperative that you
contact Amy Simpson at (559) 445-6187 if you cannot submit the report by 8 September 2003 to explain
your situation.
ANNE KIPPS
Senior Engineer
RCE No. 49278
cc: See next page
California Environmental Protection Agency
0 Recycled Paper
The energy challenge facing California is real.
