The hazardous waste consisted of used oil, used oil filters and lead acid <br /> batteries. According to manager Greg Praszek,the hazardous waste is transported periodically by West Wind to <br /> their office in Illinois. Greg also mentioned that the full trailers of hazardous waste are shipped by BNSF. The <br /> transporter could not provide valid hazardous waste transporter registration or manifest records during the <br /> inspection. <br /> VIOLATION GUIDANCE: <br /> Except as otherwise provided, it is unlawful for any person to carry on, or engage in,the transportation of <br /> hazardous wastes unless the person holds a valid registration issued by the department, and it is unlawful for any <br /> person to transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by <br /> the department.A person who holds a valid registration issued by the department pursuant to this section is a <br /> registered hazardous waste transporter for purposes of this chapter.Any registration issued by the department to a <br /> transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. <br /> Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in <br /> his or her possession while transporting the hazardous waste.The registration certificate shall be shown upon <br /> demand to any representative of the department, officer of the Department of the California Highway Patrol, any <br /> local health officer, or any public officer designated by the department. <br /> CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without <br /> valid hazardous waste registration. Provide a corrective action statement and supporting documentation to the San <br /> Joaquin County Environmental Health Department within 30 days. <br /> This is a Class I violation. <br /> 203 HSC 25189.5(c)Transported or caused transportation of hazardous waste to an unauthorized point. <br /> OBSERVATION: According to manager Greg Praszek, hazardous waste is transported periodically by West Wind <br /> to their office in Illinois. Greg also mentioned that the full trailers of hazardous waste are shipped by BNSF. The <br /> hazardous waste consisted of used oil, used oil filters and lead acid batteries. Hazardous wastes shall be disposed <br /> of only by transportation to a permitted hazardous waste treatment, storage, and disposal facility(TSDF)or other <br /> authorized point. <br /> CORRECTIVE ACTION: Immediately cease transportation of hazardous waste to an unauthorized point.
