SAN J 0 A Q U 1 N Environmental Health Department <br /> U ; i ymy 1 Iii <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> West Wind 100 S VENTURA AVE, STOCKTON June 02, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business generates used oil and used oil filters and could not provide hazardous waste <br /> disposal records for the past three years during the inspection. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action <br /> regarding the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately start maintaining hazardous waste disposal records and provide a corrective <br /> action statement to the EHD within 30 days. <br /> This is a Class II violation. <br /> 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br /> OBSERVATION: Bills of lading for the recycling of lead acid batteries from June 2, 2017 to June 2, 2020 were not <br /> found on site. Eleven used lead acid batteries were observed onsite. Manager Greg Praszek stated that the <br /> batteries are shipped to another location for West Wind in Illinois. <br /> REGULATION GUIDANCE: <br /> (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR <br /> section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or <br /> who uses, reuses, recycles or reclaims the batteries or their components. <br /> (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each <br /> manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the <br /> batteries or who uses, reuses, recycles or reclaims the batteries or their components. <br /> CORRECTIVE ACTION: Immediately start maintaining bills of lading for spent lead acid batteries demonstrating <br /> proper recycling and provide a corrective action statement to the San Joaquin County Environmental Health <br /> Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> FA0011052 PR0539720 SCO01 06/02/2020 <br /> EHD 22-01 Rev.9/20/2019 Page 6 of 11 Small Quantity Hazardous Waste Generator OIR <br /> 1868 E.
