Violation 401, CCR 66265.171. Failed to store hazardous waste in a container that is in good condition. Drums, containers, and tanks throughout showed evidence of corrosion or incompatibility in the following areas: Lab • Two (2) 1 -gallon leaking containers labeled "Foam -O -Gel -Foamy Oven Cleaner" • Pile of white powdery substance (approximately 1 cup) on a chemical shelf next to 1 -gallon container labeled Amorriatic Acid • One (1) cardboard box on the floor leaking an unknown substance • Apparent chemical staining in the lab sink with a hose laying inside it East Yard -along western fence • Twenty two (22) unlabeled or illegible blue 55 -gallon metal drums • Eleven (11) unlabeled or illegible blue 55 -gallon poly drums • Three (3) grey unlabeled or illegible 55 -gallon metal drums • Three (3) green unlabeled or illegible 55 -gallon metal drums • Two (2) black unlabeled or illegible 55 -gallon metal drums • Two (2) beige unlabeled or illegible 55 -gallon fiber drums • One (1) green and white striped unlabeled or illegible 55 -gallon metal drum East Yard -along eastern fence • Sixty eight (68) black 55 -gallon metal drums • Twenty five (25) blue 55 -gallon poly drums • Thirty six (36) blue 55 -gallon metal drums • Five (5) black 55 -gallon poly drums • Nineteen (19) grey 55 -gallon metal drums • Four (4) white 55 -gallon metal drums • Three (3) rusty 55 -gallon metal drums • One (1) grey with blue 55 -gallon metal drum • One (1) green top 55 -gallon metal drum • Three grey with greenish 55 -gallon metal drums • One (1) big grey >55 -gallon metal drum • Six (6) green 55 -gallon metal drums • Two (2) white 55 -gallon poly drums • Three storage cases full of unlabeled lab chemicals • Six (6) 55 -gallon drums of hazardous waste removed on October 10 & 11, 2015, by PARC Environmental, hired by the Department of Toxic Substance Control (DISC), as an emergency measure due to the risk and proximity to the elementary school directly across the street and downwind. If a container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it begins to leak, the owner or operator shall transfer the hazardous waste from this container to a container that is in good condition, or manage the waste in some other way that complies with the requirements of this chapter.
