r <br /> may endanger public health or the environment immediately <br /> upon becoming aware of the incident. <br /> (m) Other Noncompliance <br /> The owner or operator shall report all other instances of <br /> noncompliance not otherwise required to be reported at the <br /> time monitoring or other reports are submitted. The reports <br /> shall contain the information listed in II.6 (k) above. <br /> (n) Other Information <br /> Where the owner or operator becomes aware that he failed to <br /> submit any relevant facts in the permit application or <br /> submitted incorrect information in a permit application or <br /> any report submitted to the Department, the owner or operator <br /> shall promptly submit such facts or information. <br /> 7. Signatory Requirement <br /> All reports or other information requested by the Department shall <br /> be signed by the owner or operator or the corporations' principal <br /> executive officer or, at least, the level of vice president. The <br /> person signing the document shall make the following certification: <br /> "I certify under penalty of perjury that I have per- <br /> sonally examined and am familiar with the information <br /> submitted in this document and all attachments and <br /> that, based on my inquiry of those individuals immedi- <br /> ately responsible for obtaining the information, I <br /> believe that the information is true, accurate, and <br /> complete. I am aware that there are significant <br /> penalties for submitting false information, including <br /> the possibility of fine and imprisonment." <br /> 8. Certification of Construction <br /> The owner or operator may not commence treatment, storage, or <br /> transfer of hazardous wastes in a modified portion of that facility <br /> until the owner or operator has submitted to the Department a <br /> certified letter signed by the owner or operator and an appropriate <br /> engineer registered in California stating that the facility has <br /> been constructed in compliance with the permit and as approved by <br /> the Department. <br /> 9. Transfer of Permit <br /> This permit may be transferred to a new owner or operator only if <br /> it is modified or revoked and reissued pursuant to Section 270.41 <br /> (b) (2) or 270.42 (d) Title 40, CFR. The owner or operator shall <br /> notify the Department of a proposed change in ownership of the <br /> -7- <br />
