Failed to submit a written response within 30 days of receiving an inspection report. October 07, <br />2011, a hazardous waste inspection was performed at the facility. A phone call reminder about the <br />inspection report to facility operator was made on November 07, 2011, the day of the return to <br />compliance deadline. Facility's operator/ owner that receives an inspection report must submit a written <br />response documenting corrective action within 30 days to SJC EHD. Correct by submitting a written <br />corrective action statement for October 2011 and June 2012 hazardous waste inspection report. <br />301. Facility not maintained to minimize release of hazardous waste. Around the new motor oil blue tank <br />and nearby the used oil tank is saturated waste absorbent and spilled petroleum liquid. Per Ravinder, <br />the new motor oil supplier had overfilled the tank the previous day and placed absorbent around the <br />tank. Facility shall be maintained and operated to minimize possibility of fire, explosion, or any <br />unplanned sudden or non -sudden release of hazardous waste or hazardous waste constituents to air, <br />soil, surface water that could threaten human health or environment. Immediately inspect the overfill <br />system on the new motor oil tank and any other tanks for proper operations. Properly dispose of any <br />saturated waste absorbent into a properly labeled container. <br />402. Failed to remove waste stored in damaged or leaky container. In the truck wash bay, there is a 20 <br />gallon brown drum of waste sludge removed from the trench. Surrounding the drum is dark liquid that <br />appears to be leaking from the drum. If a container holding hazardous waste is in poor condition (rust, <br />structural defects, leaky), contents must be transferred into a container in good condition. Correct by <br />ceasing any storage of waste in a container that is in poor condition and have its contents transferred <br />into a properly closed and labeled container. <br />407. Empty hazardous waste and hazardous material containers (> than 5 gallons) was not marked with <br />date it became empty and it is unclear if they were managed within 1 year of being empty. Located <br />outdoors by the rear east property fence line are several poly and metal 55 gallon empty containers. <br />These containers are not labeled "Empty" with date. Since it is unclear how long these containers have <br />been stored on site, immediately properly manage or dispose these containers in accordance with Title <br />22 hazardous waste regulations. Submit a written corrective action plans managing or disposing these <br />empty containers or submit a disposal receipt. <br />610. A drum of drained used oil filters was not kept closed unless adding used oil filter to the container. <br />Per Ravinder, the standard procedure is to keep one open during the day and then at end of work day, a <br />lid is placed onto the drum.
