The reviewed uniform manifests (26 manifests in total) generated between June 2015 and August 2015 were found without signed off copies from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a Class II violation. 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. 1) Metal fines were noted on the floor around the metal cutting equipment located in the tooling room. 2) Metal fines and metal shavings mixed with lubricating oils were noted on and around the metal cutting equipment located in the "new tooling" area. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately repair all leaks and staining, and manage according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how these wastes were managed. This is a minor violation. 302 CCR 66265.32 Failed to maintain required emergency equipment. The onsite eye wash station, located in the "tooling" area, was not maintained. All facilities shall be equipped with an internal communication or alarm system, a device capable of calling outside emergency help, spill control equipment, and decontamination equipment at all times. Immediately maintain all the required decontamination equipment, submit proof of correction to the EHD. This is a minor violation.
