When removed from the sump for testing, the sensor split open and fell apart. The float could not be <br />located. All monitoring equipment shall be maintained to activate an audible and visual alarm or stop the flow of product <br />at the dispenser when it detects a leak. The technician replaced the float and put the sensor back together. The sensor <br />was retested during the inspection. This is a Class II violation. <br />319 <br />HSC 25291(e) Water in secondary containment not removed, analyzed, and properly disposed of (pre-Jul 2003). <br />Liquid was observed in UDC 1/2. If water could enter into the secondary containment by precipitation or infiltration, it <br />must be removed and disposed of properly. The service technician removed the liquid from the UDC at the time of <br />inspection. Ensure that all sumps and annular spaces are maintained free of liquid. This is a Class II violation. <br />323 <br />CCR 2636(f)(2) Leak detector failed to detect a 3.0 gph leak at 10 psi. <br />The 89 and 91VMI line leak detectors failed to detect a leak when tested. All line leak detectors shall be capable of <br />detecting a 3-gallon per hour leak at 10 psi. The service technician adjusted the leak detectors, retested them, and they <br />passed. This is a Class II violation. <br />326 <br />CCR 2635(b)(2) Overfill prevention system was overridden or failed to meet overfill requirements. <br />The used oil tank does not have overfill prevention. The local agency may waive the requirement for overfill prevention <br />equipment where the tank inlet exists in an observable area, the spill container is adequate to collect any overfill, and <br />the tank system is filled by transfers of no more than 25 gallons at one time. The tank form for the used oil tank is <br />marked that the tank is exempt from overfill protection. The monitoring plan for the used oil tank notes the applicable <br />code section for overfill exemption. However, no site specific information is noted explaining why this facility is exempt, <br />for approval by the EHD. Immediately update the comments in either the used oil tank form or the used oil monitoring <br />plan in CERS to include the reason this tank is believed to be exempt from overfill requirements, including specific <br />information regarding this tank, and begin maintaining logs recording the inputs into the used oil tank, and submit the <br />information for review by the EHD. This is a Class II violation. <br />2010 <br />CCR 2712(i) A copy of the UST operating permit was not found on site. A copy of the UST operating permit and all <br />attachments and conditions shall be retained at the facility.
