Pretreatment Industrial Users <br />General Permit Conditions <br />Page 3 of 7 <br />public or other governmental agency without restrictions unless the permittee specifically <br />requests and is able to demonstrate to the City that release of such information would <br />divulge information, processes or methods of production entitled to protection as trade <br />secrets of the permittee. <br />14. Permittee shall abide by all applicable provisions of the City of Stockton Municipal Code, or <br />any applicable local, state or federal code or regulations, and shall not discharge any waste <br />containing pollutant concentrations in excess of Specific Pollutant Limitations section <br />13.08.250. Any continuing violation of any provision of said codes or regulations may be just <br />cause for revoking this Permit. <br />15. Permittee shall meet all applicable regulations under subtitles C and D of the Resource <br />Conservation and Recovery Act, and 40 CFR Parts 260 through 271, and any applicable <br />State regulations promulgated subsequent to the Federal law. <br />16. Permittee shall prepare and submit a slug discharge control plan within 30 days from the <br />effective date of this Permit. <br />17. The permittee shall have a water conservation and hazardous waste minimization plan. <br />18. The discharge of excess amounts of pollutants specifically limited and deviations of pH may <br />be subject to fines for each violation. <br />19. Achieving permit conditions of specific pollutant concentration limits by dilution is expressly <br />prohibited. Any evidence of this, either willfully or through negligence, will result in permit <br />limits being redefined in terms of maximum effluent loadings. Additionally, penalties of a <br />maximum of $25,000 per day may be assessed (Stockton Municipal Code 13.08.440). <br />20. Notification of Potential Problems: <br />a. In the case of any discharge, including, but not limited to, an accidental discharge; a <br />discharge of a nonroutine, episodic nature; a noncustomary batch discharge; or a <br />slug discharge or slug load that might cause potential problems for the POTW; or <br />any discharge at a flow rate or concentration which could violate the discharge <br />standards set forth in Stockton Municipal Code Section 13.08.100, the User shall <br />immediately telephone and notify the City of Stockton, Environmental Control Office, <br />of the incident. This notification shall include the location of the discharge, type of <br />waste, concentration and volume, if known, and corrective actions taken by the User. <br />Within five (5) days following such discharge, the User shall submit to the Municipal <br />Utilities Department a detailed written report describing the cause(s) of the discharge <br />and the measures to be taken by the User to prevent similar future occurrences. <br />Such notification shall not relieve the User of any expense, loss, damage, or other <br />liability which might be incurred as a result of damage to the POTW, natural <br />resources, or any other damage to person or property; nor shall such notification <br />relieve the User of any fines, penalties, or other liability which may be imposed <br />
