wells 18, 19, and 20, which were previously installed, to perform periodic gauging, <br /> sampling, and monitoring of the deep zone monitoring wells, and to conduct periodic <br /> vacuum truck removal events. <br /> D. Whereas, Licensees desire to have a technical consultant engaged by the Licensees enter <br /> the Subject Property for the purpose of performing the work as described in the Work <br /> Plan for Additional Separate Phase Hydrocarbon Assessment, Unocal Groundwater <br /> Recovery Well Installation, and Remedial System Feasibility Study dated March 5, 2010, <br /> attached hereto as Exhibit A ("the Work Plan"). Specifically, Licensees wish to have <br /> their technical consultant enter the Subject Property to drill approximately nine soil <br /> borings to both collect soil samples and screen soil for petroleum hydrocarbon <br /> constituents. The soil borings will be abandoned as described in the Work Plan upon <br /> completion of the investigation. <br /> Now,therefore,the Parties agree as follows: <br /> 1. Licensor hereby grants to Licensees and their agents, contractors and employees a <br /> license to enter upon the Subject Property for the purpose of performing the work <br /> described in the Work Plan. <br /> 2. This license shall commence upon the execution of this Agreement and shall <br /> expire on December 31, 2010 ("Expiration Date")("). Upon written request of <br /> Licensees received prior to expiration, Licensor may in its sole discretion extend <br /> the Expiration Date. This License Agreement does not supersede the License <br /> Agreement between the Parties dated October 9, 2007, which remains in effect. <br /> 3. Although the agreed upon term of this License Agreement is several months <br /> ending on the Expiration Date (see paragraph 2, above), Licensees anticipate that <br /> 2 293554.1 <br />
