ALLEGED VIOLATIONS <br />Underground Storage Tank Violations <br />Health & Safety Code (HCS) 25284(x)(1) Except as provided in subdivision (c), no person <br />shall own or operate an underground storage tank unless a permit for its operation has been <br />issued by -the local agency to the owner or operator of the tank, or a unified program facility <br />permit has been issued by the local agency to the owner or operator of the unified program <br />facility on which the tank is located. <br />4 this facility operated without a permit after January 1, 2003. A photo of the facility in <br />operation was taken on July 22, 2003. <br />California Code of Regulations (CCR) Section 2637(a)(1) By December 31, 2002, the owner <br />or operator of any secondary containment system that the owner or operator determines cannot <br />be tested in accordance with this section shall replace the secondary containment system with a <br />system that can be tested in accordance with this section. As an alternative, the owner or <br />operator may submit a proposal and work plan for enhanced leak detection to the local agency in <br />accordance with subdivisions 2644.1 (a)(1), (2), (4), and (5) by July 1, 2002; complete the <br />program of enhanced leak detection by December 31, 2002; and replace the secondary <br />containment system with a system that can be tested in accordance with this section by July 1, <br />BonFare Market #35 <br />15 E.
