Code <br /> Title 14, Sec. 15082 (x) <br /> City of Stockton (IS25-90 ) —Proposed Negative Declaration/ <br /> Expanded Initial Study for the Austin Road Sanitary Landfill <br /> 5-Year Review <br /> Dear Mr. Niblock: <br /> The San Joaquin County Department of Aviation (Stockton Metropolitan <br /> Airport) has reviewed the above-referenced documents regarding the <br /> Austin Road Sanitary Landfill 5-Year Permit for continued use (IS25-90 ) <br /> and the Proposed 50-Year Expansion (EIR2-90 ) with respect to those <br /> areas germane to the operations of the Stockton Metropolitan Airport. <br /> As with other proposed developments in and about the Stockton <br /> Metropolitan Airport, the Department of Aviation has serious reserva- <br /> tions about a project of this nature being located so close into the <br /> Airport operational area. Our concerns, comments and recommendations <br /> relative •to this project are as follows: <br /> 1. Although the Austin Road Sanitary Landfill site was originally <br /> opened in 1954, long before the advent of the jet aircraft and the <br /> extension of the air carrier runway at Stockton Metropolitan <br /> Airport, current Federal Aviation Administration regulations now <br /> prohibit the location of landfills within the 10 ,000 foot extended <br /> approach and departure area of any runway used or planned to be <br /> used by turbine powered aircraft due to the bird attraction and the <br /> threat they pose to arriving and departing aircraft. <br /> 2. While the Austin Road Landfill was recognized to be within 10,000 <br /> feet of the Stockton Metropolitan Airport turbo-jet runway when the <br /> Department of Transportation, Federal Aviation Administration, <br /> (DOT/FAA) Order 5200 .5 was issued on October 16, 1974 (See Exhibit <br /> A) , the FAA did not penalize the Airport operator, San Joaquin <br /> County, by restricting turbo-jet aircraft operations, order the <br /> landfill site closed or deny the County Federal funding for non- <br /> compliance with Federal Grant Assurance Agreements. Instead, the <br /> FAA chose to simply "grandfather" the existing landfill and publish <br /> a permanent Notice to Airmen (NOTAM ) advising and cautioning pilots <br /> of bird activity (SEAGULLS) in and about the Stockton Metropolitan <br /> Airport environs.
