II. Project Description <br /> D. USE OF S EIR BYO R AGENC S <br /> Several local, state,and federal agencies exercise discretionary approval over the expansion of <br /> the landfill,either directly through the issuance of permits or indirectly through the development <br /> of design and operational guidelines. <br /> The Austin Road Landfill is currently regulated under two operating permits. the Regional <br /> Water Quality Control B (RW )issued Waste Discharge Requirements,Order No.90- <br /> 122(1990)and Order No.92-143(1992);and the San Joaquin County Public Health Services <br /> issued Solid Waste Facility Permit,number 39-44-001. <br /> As the public agency principally responsible for approving the project,the City of Stockton <br /> Department of Community Development Planning Division is considered the Lead Agency <br /> under CEQA,and is responsible for reviewing and certifying the adequacy of this EIR. <br /> However,a number of other agencies are expected to have an interest in the proposed project. <br /> Some interested agencies have discretionary authority over aspects of the project;these are <br /> considered Responsible Agencies under CEQA. These Responsible Agencies will also consider <br /> the adequacy of this EIR as it relates to any action in which they have discretionary approval <br /> power over the project. <br /> Agencies with a regulatory role in establishing solid waste facilities are discussed in detail within <br /> the relevant sections of Chapter III of this ;approvals required by these agencies are <br /> summarized below. <br /> gGktgn rite CoLncit_-The City Council has the authority to approve of the acquisition of the <br /> Brocchini parcel (negotiated purchase or may require condemnation proceedings),approve of the <br /> proposed zoning and prezoning and filing of an application with the Local Agency Formation <br /> Organziation CO)for annexation(or portions thereof)of the property to the City of <br /> Stockton,approve of the project plans and specification,and award a construction contract for <br /> the proposed landfill expansion. <br /> Stockton Planning Commission-The Planning Commission makes recommendations to the City <br /> Council regarding zoning and prezoning of the properties prior to annexation to the City and <br /> makes a determination as to whether or not the proposed landfill expansion conforms with the . <br /> City's General Plan. \ <br /> 11.38 <br />
