EXISTING PERMITS AND APPROVALS <br /> The Foothill Sanitary Landfill operates under the following permits and conditions (see <br /> Appendix A for copies of these documents): <br /> • Solid Waste Facilities Permit (SWFP)No. 39-AA-0004, issued by the California <br /> Integrated Waste Management Board <br /> • Waste Discharge Order No. R5-2003-0020, issued by the California Regional Water <br /> Quality Control Board (RWQCB), Central Valley Region in 2003 <br /> • Permit to Operate N-4070, issued by the San Joaquin Valley Air Pollution Control <br /> District <br /> • Land Use Permit UP#3295 <br /> • Land User Permit UP#3451 <br /> 2.4. CEQA PROCESS <br /> At the time when filling operations began (1966), the California Environmental Quality Act <br /> (CEQA) did not exist. It was not until 1970 that CEQA was enacted. Section 15261, Title 14, <br /> California Code of Regulations states that public agency projects approved before November 23, <br /> 1970 and private projects approved before April 5, 1973 are exempt from CEQA until such time <br /> that changes to the project are proposed which might have a significant effect on the <br /> environment. No such project changes are proposed in this JTD. <br /> In 1995, two CEQA documents were prepared: a Negative Declaration (95-OIND-75100, <br /> March 29, 1995), and a Notice of Determination (April 28, 1995) (See Appendix A). <br /> 2.5. CONFORMANCE FINDING INFORMATION <br /> San Joaquin County has prepared an Integrated Waste Management Plan (April 1996).
