Mr. Jim Ronyak <br /> Page 2 <br /> If the Board proposes a facility for the List, the affected <br /> operator will be notified by certified mail. After 90 days from <br /> the date of notice or upon notification that all violations have <br /> been corrected, Board staff will re-inspect the facility. If the <br /> facility is still in violation, the site will be placed on the <br /> List. <br /> If a facility is included on the List, Government Code 66796.39 <br /> requires the Local Enforcement Agency (LEA) to develop a <br /> compliance schedule for correction of the violation(s). If <br /> compliance is not achieved within one year of the date the site <br /> is placed on the List, Government Code Section 66796.39 directs <br /> the LEA to revoke the facility operating permit until such time <br /> as the violation(s) of the standard(s) are remedied. <br /> The goal of the field evaluation program is to verify compliance <br /> with each State Minimum Standard, not merely to document <br /> violations. Inspecting each facility three times over a period <br /> of approximately one year will provide a track record of <br /> compliance at each facility. It and will also allow for the <br /> proper evaluation of standards which show seasonal variation such <br /> as drainage, erosion control, and dust. <br /> Although we do not intend to provide advance notice of the <br /> inspection dates to operators, the Local Enforcement Agency (LEA) <br /> will be notified and will be invited to accompany our staff on <br /> inspections. <br /> If you have any questions regarding the results of this <br /> inspection or the field inspection program, please contact me at <br /> (916) 322-1769. <br /> Sincerely, <br /> John K.
